Bankruptcy/Creditors’ Rights

• Represented financial institution in obtaining successful resolution of defaulted $9 million commercial loan secured by a single-tenant office building, including obtaining relief from stay and successfully opposing borrower’s effort to confirm “cram down” plan in borrower’s chapter 11 bankruptcy proceedings.
• Representation of commercial finance lender in prosecuting numerous breach of contract and breach of guaranty lawsuits, including obtaining and enforcing writs of attachment, enforcement of judgment proceedings, and related bankruptcy proceedings.
• Defended numerous creditor clients in actions brought by chapter 11 debtors and bankruptcy trustees for recovery of alleged preferential and/or fraudulent transfers.
• Represented commercial lender in connection with borrower’s chapter 13 case, including issues relating to claims allowance and provisions of contested chapter 13 plan.
